From http://news.bbc.co.uk/2/hi/uk_news/england/london/8163428.stm the Beeb:

A UK woman is seeking a judicial review after being, she says, detained and handcuffed by police who wanted her mobile phone after she used it to film them. Police had stopped her boyfriend on suspicion of carrying drugs. They found none, and then tried to take the woman's phone, citing anti-terror laws.

The video at issue can be seen at the BBC link above. The report is unclear about whether the police actually confiscated the phone.

good thing if this would go to court, some legislation on the subject might get the police on the right track on this

Why have those copper got their shirts over their stab-vests?

Sadly I think the Met will settle out of court if they can

Is it up to them? I can see where they would want to settle but isn't a settlement (or not) the decision of the compalintant?
Hope she sticks to her guns on this.

The system I’m afraid, if she takes the money nothing changes, if she presses her case she compromises it by handing a “hidden agenda” angle to the defence lawyers

It needs a closer contest, one the Met think they can win

If she states publicly that she is pursuing the case to clarify the law or establish a precedent or something similar wouldn't that eliminate the "hidden" part?
I understand that my expectations of the US legal system don't translate to any other legal system but I hope that there is some way to get this sorted out for the pohographers in the UK!
