According to this article, "police Chief Jim McDonnell has confirmed that detaining photographers for taking pictures 'with no apparent esthetic value' is within Long Beach Police Department policy."

I did try a search prior to posting...and I can see why people don't use it: it's a pain (and locks you out for 60 seconds at every attempt, failed or not).
