Dear All,

A friend of mine from another forum complained to me that a photo of his is being posted on another website without his permission. What should he do to rectify this infringement of his copyright?

Contact the site admin that the photo is being used without his permission, and that he wishes to have it removed. Give them a chance to do the right thing.

I guess I would start by contacting the people who run that other site and explaining that the photograph has been improperly absconded with. Most decent people will respond to that, I would hope. If it has to go farther than that, a lot depends on where the photo was copyrighted and where the copyright was violated. But I'm no lawyer - therefore asking the site owner to remove it seems like the best way to begin.

According to the book on Copyright law I've got, it helps if he's registered his copyright. If the pic is worth $, it will double the amount he'll get in court if it goes that far (I think it cost $30 to register the copyright).
Their are a number of web sites, run by lawyers, that will give him up to date answers.
 
pete, I hope your friend has the original some place....in case evidence is needed. But usually, if your friend contacts the site owner and mentiones that he's the copyright holder of the photo , they comply.
 
I don't know if this is true or not but I've heard that if you send yourself a registered parcel with the material you own inside, it's considered to be proof of copyright as long as the date is readable and the seals haven't been broken.

Anyone here know for certain?

Thanks guys and gal! My friend sent an e-mail to the webmaster and showed the link to his photo and they have removed the offending picture and apologised. What should he do if the webmaster ignore him? Legal actions?
 
The basic thing you need to do if you want to protect written or visual material is not on it that it is copyrighted when you post it. It's not necessary to file anything immediately with the Copyright Office. The key is to get on the record that the material is copyrighted. If you don't take that initial step I suspect it would be a long haul in court.

If your friend is in the U.S., go to the copyright office website...
download form VA.

You can send a batch of stuff....$30 and the form.
An intellectual property attorney will most likely not touch a case if you don't have the stuff on file.
Sounds like this situation worked out for your friend, but for the images you really value....and think other might value as well...protect it!

I sometimes think about the pictures we have posted in the galleries here at RFF. I suppose we are protected by the statement that all photos are copyright by their owners? Is that enough?
 
You have a copyright as soon as you take the picture, but it is more defensible in court if you have the item(s) registered.

You're talking about US copyright law. It's different in Canada and most other countries.
