AS the title says, the Wedding Photographer asked for a "Album Cover" charge within the order form, BUT, the contract never mentioned that extra fee, nor was that charge brought up during the contract signing...

Personally, I would have a contract that stipulates that the couple can have a "Album Photo Cover" at an extra charge the time of ordering
OR.....
just include it with the package price... Really, a package is a package!! not a piece meal arrangement.. Make it one or the other...


And make it very clear in the contract what is included, and what is NOT is included in the text of the contract.
This is the where the Photographers Contract was misleading.... ^^^^^^^^^^^^^^^^^^^^^^^^^^^

IMHO, this is an instance of bad faith. Unfortunately for the bride and groom, all they can do is either to pay up or sue the photographer. Or they can pay and then file a lawsuit.

In a court of law, this should be an open and shut case. In interpreting contract language that is vague, there is a general doctrine known as "contra proferentem (against the offeror)", i.e., the prevailing meaning should be the one that works against the party who drew up the contract.

I'd ask for an album without cover as contract does not require to order that expensive cover, not even lists it. Word additional doesn't mean mandatory so asking to order it means flushing down the drain his business.

This is none of my business, but charging a separate $150 fee to put a cover on an album, when they just dropped $6k on your desk?

The contract doesn't mention anything about any additional charges for a cover.

She had to shut down her facebook and blog for a few days and she is hurting. Nearly every customer she had booked has cancelled and there are a lot of people posting comments which has driven away potential new customers...

NBC5 investigated the couples claim and found the photographer is in breach of contract as has several Lawyers here in DFW.. A judge has even spoken up in defence of the couple..and yes I do know NBC5 has no legal grounds to help but they are doing a good job of getting the word out. They have kept this issue front and center...

NBC5 posted the complete contract and read it in full..

Nowhere is there any mention of the album cover or a charge due for it..

She has even now stated if the couple does not pay by Feb she will add a archival fee starting at $500 and going up each day...

Yes, they made a mistake by not having the contract checked first by their lawyer. 😉
I give this couple two years max. and they will divorce because they fight over some irrelevant sum of money.

Actually the couple was probably a royal pain to work for ,
Demanding, asking for the moon and stars .
Rich people are used to getting their way and
Ruining anyone that disagrees with them .
They have made this personal over $150
Which to them is like a cup of gas station coffee
To the rest of the world .

If you have ever shot a wedding even a friends
It is a horrible experience ,


Maybe the photog is a train wreck ,
But my money is that the clients were total a wholes .

Gosh, I found the reverse. The so-called rich I had as clients were the easiest to work with. They didn't complain and didn't nickel and dime me to death. Or maybe it's my ghost typing this! Ha!

Rich people in Minnesota may be a bit higher class than rich people elsewhere.

That is the complete contract and there is no mention whatsoever of the album cover..

This photographer has been in the news before over shady dealings and she has lost that case.. I suspect she'll lose this case also..

Her BBB rating is not good either...
