Model Release anyone?

Does anyone use model release forms when photgraphing strangers on the street? I would assume you'd shoot first, so not to lose the moment and ask later. So far I have only shot (not with my syringe 😉 ) friends/family or their kids. Everyone so far has been okay with that as long a they get a copy.

The only time I have used model releases is for commercial work. The images were used on a business' web site and brochure. As I understand things you don't need a release if the photo is not used commercially, but is used artistically (and that can include a book of your work). I've read several things on the web about the subject, and the ones I give any credence to at all are written by attorneys. Basically, when we are out in public, we are just that -- out in public -- and there is no presumption of privacy. I'm sure others will chime in on this subject, and there are attorneys that are members of rff. What I've written is my understanding of US law, and other nations are probably different.

You only need model releases for commercial shooting, in the UK and US anyway. Otherwise you can do anything you like with pictures you take of strangers in public places, including publish them on the web, in books, or galleries.

I do carry small "pocket" release in my day bags - I'm of the shoot first, ask later crowd.

I don't ask for a release all the time - but if I think the image may have value, I do. In the case of street performers, I pay them as well.

Ian has it right, unless you are using the photos commercially, you don't need it in the US.
 
Here's the info from a "simple" form". Copy the info, then paste into a Word document. I usually make four 4"x3" cards on a 1-page document, arranged in Landscape format. Then print and cut them accordingly.

MODEL RELEASE
I, for valuable consideration received, hereby give permission to _____________, photographer, to use my name and photographic likeness in all forms and media for advertising, trade, licensing to third parties, motion pictures and any other lawful purposes.
