Hello,

I think I just got scammed again.

I bought an M6 camera from a 0 feedback seller registered in Finland. I paid the 750€ by PayPal. Immediately he marked the parcel as sent. A few hours later, I received a message from EBay saying the listing has been removed and the seller is no longer a registered user on EBay. The message of EBay is confusing because, firstly, it doesn't tell you if the seller left EBay himself or he was forced to leave it and, secondly, it says the transaction might continue and I might still receive the item. I tried to contact the seller via his PayPal email address, in vain.

I wrote EBay and PayPal immediately but it's been 48 working hours and I'm still waiting for a response. PayPal promised a response in 24 hours.

I hope I can still get my money back since I paid by PayPal. But I'm not entirely sure.

My first question is: am I still under PayPal's Buyer's Protection once the original listing has been removed by EBay?

Although the money was sent (which would make me a buyer I guess), it's now impossible to access the original listing. No item description, no condition of return, absolutely nothing except the title.

If I'm entitled to PayPal's protection, I'm looking for a quick way to get my money back. PayPal's website suggests automatically I open an EBay case first. Once the latter is opened, I will have to go through a step of communicating with the seller in order to obtain a friendly solution. However, it's absurde because I would be talking to no one, as the seller is now gone.

My second question is: is it possible to open a PayPal case directly without using the EBay's litigation procedure?

Also, in the unlikely event that I did receive a parcel from the seller, should I simply refuse it? It could be a rock inside, or an M5.

I'm a registered user on EBay since 2005 but it's only my second time of encountering a serious problem. Any help is appreciated.
 
PayPal has real people behind. Go to your PayPal account, contact and it will generate key to call. I spoke with PayPal people few times it is not call center in India.

This has happened to me. I filed in the resolution center with the reason marked as "listing removed from ebay." Money was returned after a week.

Check your email or go to a computer to check the item number. Checking from the phone will not show the item number of a removed item.

I don't want to be blunt but I don't understand why the hell you took such a risk. Especially for a M6 which you can find everywhere at approx. the same price from serious sellers. And you live in Paris where there are even street shops selling real M6 bodies.

What Ko said about PayPal. Open a PayPal case right now and once done call them on the phone.

If the PayPal funds source is your credit card you can also have the debit cancelled by your bank if you contact them by phone or in person then with a registered letter telling them that you bought something online and that the seller then vanished and never sent the item. It's one of the warranties you can also benefit from, at no cost. If the PayPal funds source is your PayPal account or your own bank account it's all up to PayPal.

This is why always funding a PayPal payment with a protected credit card is another security for the buyer.

Same thing happened to me. I got my money back no issues.
I didn't call ebay or paypal, I just used their messaging system.
Remain calm, it will be ok.
 
About 20 years ago, I lost $300 due to a dishonest person on EBay in a similar transaction to yours. Hopefully, EBay has improved a lot since then.

I'm going to open a PayPal case and to call PayPal tomorrow if I still don't get a response from them. I just checked, the buyer now has 180 days to file a complaint, instead of 45 days, so time is abundant. It seems I can skip EBay and go directly to PayPal.

Nomadia, is the resolution center you mentionned of EBay or of PayPal?

As to Highway 61, I took the risk mainly because of the low price. Although I bought my first M6 for 650€ in 2009, they cost at least 850€ in France now. In shops they usually sell for 1000€ and more. But I would have never bought it, hadn't the seller accepted PayPal as payment method.
 
A similar case (listing removed, seller excluded, already paid) happened to me last year although the amount of money was much smaller. After reporting it to eBay's resolution center, I got refunded fully after a week or so.

In my case the seller's account was stolen by a hacker and then came the fake sales. I think the seller called police and they got the hacker in the end.

I would try to reach ebay first.

I recently bought a $20 item from a "seller" who had hacked another Ebay members account. When I sent a message to the "seller" asking for the ship date I got a message from Ebay telling me that the sale had been cancelled due to a hacked account. They told me to file a claim via Ebay stating that the item was not received. I did so and they approved the claim in three days and Paypal refunded my payment at the same time. Paypal relies on Ebay to initiate the cancellation and close the claim. Then they do the refund. It was a simple and reassuring process.
 
Open a case with eBay's resolution center. This should be your first step. Establish an audit trail. Follow their process. Once they are satisfied that it is a legitimate claim, eBay will instruct Paypal to issue a refund. You will get your money back. Trying to out think the resolution process will only cause you some grief.
 
The fact I am somewhat reluctant to open a EBay case is because every single time I try to do it from the website of EBay France, I was directed to EBay Germany for some reason. The response I just got from EBay is also in German, whilst I've never asked for that language, and my initial request was sent in French from EBay France. They managed to understand it and replied me politely in German...

The seller was registered in Finland but he wrote the description in German. Perhaps that's why. In Europe, EBay translates automatically all listings to your language, to encourage you to buy from other countries. But once you get into trouble with a foreign seller that uses another language, you are condamned to use the seller's language, and EBay won't help you translate anything anymore. It is fortunate that I know some German, but if it was Bulgarian, I would definitely want to hang myself.

I will call both EBay and PayPal tomorrow.

There is currently a mint minus chrome M6 0.72 in the Leica center of Lyon for 850.-€ with a 6 months warranty. At the end of the day it's less expensive that all the hassle you are going through now with your eBay scam.

A friend of mine recently bought a very nice chrome M6 0.72 from a private person for 650.- € (in France too).

eBay is a nice tool in that you can find pretty everything you are looking for and PDQ, but there are some dark sides as well, the main one being that you are buying blind.
 
That happened to me when I bought an Industar 61LD for £8 from Ukraine from a 0 feedback seller. It was little enough reisk and someone had be the first to buy and leave feedback.

The listing was ended and the account closed. I actually received 2 I61LD's, though niether were the particular one listed.

I've written to the address on the returns label that was on the parcel to ask if the seller still lives at the address as I'd like to return them, without refund, but I've had no reply.

@Ulrich.von.lich, How long is it since you ordered the camera?
