well at least for the Walker Evans bit Levine was clear on her ability to use those pictures because she either got the rights to reproduction or they were in the public domain (as per the Metro).
if she made an unauthorized reproduction of a copyrighted photograph she would get the **** sued out of her.
in the US if you do not substantially change the image, you are not covered under fair use. the law is clear in that regard.
After Walker Evans is not art, I appreciate that she was at least trying to say something about ownership but she should have at least painted smiley faces on the pictures instead of being lazy about it.

3. People who make derivative works get sued all the time. Shepherd Fairey was involved in one over that Hope poster where a Judge flat out told him he would lose if he tried to fight the AP over it and that work was substantially more different than Levine's were

The law says other attempts at contact are meaningless. If you want your work removed from a website, you have to go through the DMCA procedure.
It's a snapshot of a sign, in which the sign is the sum total of the creative work exhibited. The proper course of action isn't to turn to the law, it's to e-mail the blog owner and ask them to delete the image. If they refuse, then you can go DMCA.
While we can gnash our teeth at websites ignoring basic copyright law, this is a somewhat more complicated issue. It's understandable for a bystander to confuse the original image with one any millions of tourists take of signs and places they've visited and throw them on Flickr, because it doesn't appear to be a 'work of art.'

Not directly analogous, but we can see here where one must have an element 'of originality' in an image for it to be considered copyrightable. I'd say that the original image would be extremely shaky on those ground - it's a head-on image of a sign and trademark created and owned by someone else.

I am perfectly aware that people take public domain work and use it as if they were the original author. Disney did it way before Levine was even born; almost all of the early movies were lifted directly from Scandanavian folk tails.

, While visiting the Czech Republic a few years ago, I ran across an Art House Theater in Brno rhat had a big Poster hanging on their building of two kids in Batman costumes. Really cool picture. Just so happens I took it in 1971 when I was 12 years old.
Whaddya gonna do? Nothin. Might as well take it as a compliment.
This is kinda like the Stolen Scream in a way if you have heard of it. Not a lot you can do but I found Noam's perspective on it interesting. He is everywhere.
