Next time you might want to act more honorably than you did. Why (even though they might be) call someone "assholes" before you know the facts? ....
Lol. Someone steals your stuff and then you don't act all honorably about it? What a laugh!

As others have suggested, read up on Facebook's usage and adverticing policy. *It* did not give rights to anyone, *you* did by signing up to Facebook and agreeing to their terms and conditions.
...
So you are claiming then that facebook sold the rights to the photo to the club? Again, a laugh a minute around here. It is _very_ _clear_ that the club stole the photo from both facebook AND the OP.

No, what I'm suspecting is that the "widely subscribed coupon e-mail" the club sent around is some kind of Facebook newsletter. In this case the OP is basically hosed. Of course you can always try and sue, but in this case - good luck with that.
If you want to claim intellectual property rights on your pictures, don't posting them on a site where you have to agree that you're basically giving up all your rights. Is that so difficult to understand?

What? You think that facebook is sending the newsletter? Where can I can find out about these facebook newsletters? I'm a member of many facebook groups and I've never received any such newsletter.
And by posting the photo on facebook you are giving facebook the rights to the photo, not the club owner. Is that so difficult to understand?

No.

Never received a mass message on Facebook, like when someone sends mail to all their "friends"?
And by posting the photo on facebook you are giving facebook the rights to the photo
Do you find that normal? More so if the rights are transferable?

I find it normal for facebook, yes. And the fact still remains that I'm quite sure that the club owner never bought the rights for the photo from facebook. Clearly, he believes the photo to be his under the mistaken belief that because the photo was taken in his club the photo itself is his.
Seriously, how much money do you think he owes you? or is it you just want him to stop using the image? I can see hiring a lawyer if your photo was used, without your permission, on a pop album cover... but for this, it just seems like a waste of money.

From the other side of the pond' this looks a mess to me.
Looking at the photo I wouldn't have known where it had been taken or by whom. I presume OP can prove its his photo that has been used.
Incidentally what does the musician think about the situation? I would have thought his point of view might be of some interest.
Continuing with the matter I am sure that any involved lawyer will gain. But who else will? And who will be worse off?
I haven't grasped why the photo was put on facebook in the first place - have I missed something?
I think Chris has a very strong argument looking at the situation from his standpoint - but it isn't quiet that of the OP. From the OP point of view lessons have been learnt and life is too short not for it to move on.

What do you think musician has to do with the situation? Although the photo is OF him, it is not his photo.

Hey guys, let's keep our cool. This has been an interesting discussion but the temperature can't keep rising. Simply discuss the topic without the little digs at others with differing opinions.

the whole thing has played out. despite his claims of "talking to lawyers" the photo is down and "un-tagged"?
if you don't have a track record of making $, can't prove he has impeded your ability to make $ with said photo and cannot also prove he has benefited ($) from use then you aren't going to come away with $.
save yourself the money (lawyer) and effort.

ah, there is nothing more fun than watching a bunch of folks who don't know what they are talking about get into arguments about it all.
and then trying to convince others how to behave according to their values, ethics and i want to be right attitudes.
