I just read the part about the auction having been stopped due to the seller violating Stephen Gandy's copyright...

Let me just say this, and then I'll get off my high horse. I see auctions like that all the time. People don't know what they have, so they Google and find Stephen Gandy's or Karen Nakamura's write-ups, and they just cut and paste - photos, text, and all sometimes. They don't say that they got it from Stephen or Karen, they make it seem like the photos are of their camera and the text is because they know all about the camera themselves, etc. They are dishonest people. I don't care if the seller is reading this or not - he steals other people's words, he is scum. Stephen Gandy says quite clearly on his website that his words belong to him - not to some scummy eBay seller.

I find auctions like this all the time on eBay. I won't bid on them, and I send Stephen Gandy or Karen Nakamura e-mail to let them know that they're being ripped off (again). They always write back to me, they're very nice - and they always stop the eBay auctions that are ripping them off. I didn't see this auction, but if I had, I would have reported it to Stephen.

I don't buy from these folks. If they will steal words from Stephen or Karen, they will lie to me about the description of the camera. They are already crooks, I won't deal with them at all, for any reason, I don't care how good the price is.

Hey seller! You're a fraud, a cheat, and a liar. Give the lady back her money and redeem a tiny bit of your soul, you pond-scum.

I always check these items out and help her to write up the descriptions. We have never had one problem until early this year when she sold a Nikkor 50mm macro lens. I thought I had checked everything out on it but forgot to check and make sure the diaphram was working. It's hard to believe that I forgot to check it but I did. When the buyer received the lens and emailed us and said the lens wasn't working, based on his excellent feedback, we immediatley sent him a complete refund. He later sent the lens back, and he was right, the lens would not stop down. This is how your selller should have handled this problem. Instead of being a hard ass, he should learn that mistakes are made and for the sake of good business- do the right thing!

Well, here's the happy end. Five months later and that ebay seller refunded me for selling me a broken Olympus 35RC. Now, does anyone have Oly 35RC for sale? In working condition, of course🙂

i have one in great shape but it would be more than 40 bucks.
i paid more than 40 is the reason.

but it also has an original oly hood, yellow filter & wrist strap.
it works perfectly.
the only downside is someone along the way engraved a number on the bottom of the camera.

I'm trying desperately (and without any luck) to get one here in the UK but they never go for less than about £40 on ebay. Postage will bump that up to >£45 and I can't afford that; it would need to be about £35 all in. Just have to wait until someone mis-lists one... 🙁

I am a regular Ebay user. I buy and sell cameras mostly, and never buy from a seller without a good rating (100% is good, anything else is not). I bought once from a guy in Brooklyn (I'm in Seattle) who had no rating, but I searched his name on the web and found out he had a website and was a photography teacher at a school there. And yes, it was actually him (his website and his email address coincided - they were private). So it would be hard for him to evade me should the camera turn out to be broken. I can get very loud when someone cheats me. The key is, never buy from someone without a 100% rating unless you can verify who they are and what sort of person they might be and concrete contact information. Some users use Ebay's trust dependent philosophy for fraud because it is so impersonal. Easy to cheat people you don't have to deal with face to face.

As a seller, I never sell outside the country (USA) - so I can deal with the post office easily should things get hairy. I also never sell to users with bad ratings or who try to talk me into selling outside ebay. I report them immediately (those who request sales outside ebay). Everything should always be done by the book so the buyer or seller or both have all possible tools at hand in case of trouble.

You know, I wonder if it is illegal to post a public blacklist of Ebay members who cheat.

I'm mad about my 35RC, too. I bought it new 'way back when and enjoyed using it - it's a dandy little camera. Unfortunately, when I moved in 2000 I had it sitting on the couch ready to go in the car, and one of the green-card movers lifted it. They ignored my Yashicamat 124, thankfully. I replaced the RC with a Stylus, which is also a pretty nice camera and stays with Olympus.

I'm presently working on a "situation" with a seller and buyer. Long story short: I won and paid for a 28-105mm Vivitar lens. Total cost, inc. shipping was less than $25. The seller also sold the camera it was on and now claims that the lens was "accidentally" shipped with the camera to the other buyer. A full refund was offered but I want the lens.

The other buyer was to return from a trip last Tuesday and the seller said they won't answer her emails. The seller also said she is going to use ebay's "Square Trade" arbitration to resolve the issue if necessary.

We'll see what happens.

I would disagree with the 100% rule. I think the feedback words are more important and the general trend. If someone has less than 100%, I will check out both sides and make a judgement.

For instance I have 2 negs out of several hundred. In one auction, I sold some bike parts for my son. As soon as the auction ended, I sent an invoice. A week later I sent a reminder and again a week after that. I then received a reply that the guy no longer wanted it because he had bought another and I could stuff it where it hurted. I filed a non paying bidder alert and left the appropriate feedback. Funny old thing, I got a neg back. Does that make me a bad seller?

On the other I bid and won a camera. During the auction I asked questions and was assured that it was fully working. It was complete rubbish. I emailed the guy who said I could return it for a refund of the bid price paid less listing fees, final value fees, paypal fees and postage. I replied that he could get a refund of paypal fees and final value fees. I received no response. I emailed another couple of times with no response so I filed a complaint with paypal. The reponse I got from the seller was that the value of the camera was not important and how dare I impune his reputation. Furthermore, he requested my home address as he felt I needed a lesson in manners! Prior to this his feedback was 100%. Since then he has collected more negs. Does that make me a poor buyer?

If you look at Aki Asahi's feedback, he has 1 neg. The words actually say what a wonderful deal it was and how great the service!

There are many good sellers who have less than 100% but when you check these are from poor buyers and vice versa. There are also poor sellers with 100% who bully their sellers into not leaving a neg for fear of retaliation. The one sort of seller I will not buy from who is the one who says "I will leave pos after you, you will get what you give" I ask myself "what has he got to fear?"

It's also a good idea to check the feedback of people who leave negative feedback. Often you discover that they complain about most of the things they win. -- Never satisified.
