After all, a few years ago Microsoft patented double-clicking the mouse, and holding the mouse button down; thus using the law (whatever it means) as a leverage to be in a position to hold others at ransom. If Mr Miller was really trying to do something for the benefit of the photographic community there would be no need to involve lawyers to draw out pages of fine prints so that he "owns" the definition; before you know it you might need to pay to get a licence to call your work a "photograph".
