What should I do ???

Yeh I know sniper is right; it just seems like he never posts anything constructive, just negativity towards RD1 and its userbase. Correct me if im wrong, which I probably am ! So Im sorry, not tryin to start arguments etc after been here only a few days, I just want the best possible outcome out of all this, and his comment didnt seem very helpful that early in the morning !

Anyway I think your all right in saying I should return and purchase new from Matsuiyastore (sp?) . The only thing that put me off from buying there in the first place was the understanding that I would pay a hefty amount in import tax. Is there any other Aussies in here who've bought from his store ? If so, can you tell me what kind of import duty you paid ?

A Number of people made purchases from there - mostly lenses. But cameras as well, I think Keith is the one who got his Zeiss Ikon from them.
As a side note, tekst, - people are trying to help you and you react strange, to say the least. Unless that R-d1 od your "fell off the truck", it's ONLY logical to return it, get your money back and buy a normal, legal and new copy of it. I really don't see any other choice. And I dont see why you would EVER want to try to fix it if you have option to get your money back and get a BRAND NEW WITH WARRANTY camera?
Now, if you have had one, it got broken , etc., etc., and you were looking for a way to fix it - I can see why you wanted to explore those options. But for a just purchased one, and returnable? Why would you want to bother, unless, like I said before, - it's "hot"?
Anyway, check with Keith - he can let you know about Aussie fees on purchases from Matsuiya store.

no! dont leave neg feedback at this stage..if you do that that where it ends and you are stuck with the camera. its a bit of a maze on ebay but somewhere on your page you will se a small link to item not recieved..click on it and follow through the procedure (if you cant see it shoot of an email to ebay about it and they will respond)...all it does is ask you to outline the details of whether you received it or not or if the item was not as deiscribed and the seller has to respond, ..in your case is not as discribed , does not function and broken. dont be tempted to speak on behalf of the sellers claims that it was damaged in transit thats his problem. after that you can 'exculate' (thats what they call call it) the claim to pay pal to get your money back but the first step is to let the seller have the chance to refund without objection.

Anyhow, who says the seller is going to co-operate ? if I do decide to return it he may just completely ignore my questions/requests from here on...

i dont have any experiance with that store so i cant help..i can tell what the import fees are more or less.....baciaclly anything over $1000 AU imported (from ebay for example) including postage fees results in the camera going through customs and they charge you 10% gst tax plus umm,,i forget it about $60 (might be more) or so for handling fees (its also a bit of a pain because it takes a week or three longer to get)...so in essence it will cost you and extra $250-$350. unless the seller can put it through and fib about the purchase price which i am not suggesting but on occassion they do. if they tick it off as a gift you have a small chance of avoiding the taxes but i wouldnt bother (just asking for trouble) unless it was from a private seller and in a way without lying you can claim to be friends and it is a gift but i have found that even then they still ask the gst tax...if you have done your shopping around you will know if its still worth while to buy overseas

we photogaphers or photo nuts (whatever you want to call it) sometimes get pretty emotional about our gear...we may of used a brand for yonks and become attatched to em. i tend to think of Lsniper and the few guys that are crazy fanaticle about their Leicas as the pendulum effect here on RFF. both sides get a bit crazy and inflamatory at times (its somewhat amusing at times) but i think amongst all the sacasium every now and then, relevent points (and faults) are revealed and helpful ...the trick is to look past the hidden agenders and glean the small helpful points made whether they are for or against is all good. no camera is perfect

firstly dont return until you have an agreemnet from the seller that he will refund the money. and obviously you should insist he does without question.

secondly while its very disappointing for you not to be able to use the camera you have no choice now but to accept its going to be somewhat drawn out amount of time before you will have the camera you want. unfortunate as it is, thats what it is. but you will eventually get what you want.

thirdly he either will co-operate or he wont. if he does then all is fine apart from you have to be patient to get a new camera. he he doesnt then you have the ebay and pay pal system to help get the money back. also because you say he is not that far from you you could easily take legal action and make a small claims case against him through the courts which are inexpensive (small claims court)....if all of them fail, if you have some hell angels as mates they are usually pretty convincing negotiating terms 😎 personaly i would go and see him myself to hmm.. negotiate haha

Mm your right once again chippy, Ive contacted the seller and told him I intend to return the camera with a full refund. He's not so quick to respond to his emails anymore ! Haha funny you should mention that, mate o mine actually is a former hells angel..

Hi, I don't think you should go through any reporting process on ebay until you contact the seller and tell him bluntly that you want a refund of your money and ask him to do it immediately. I suspect you may have used paypal and if so then you have lots of recourse, he probably knows this. You just have to stop being indecisive, that may be why he is not offering a refund, you may have given him the impression that you'd try to fix it. I saw the auction for this camera and it showed the Epson box and the outer box for the set. Anyone that has an R-D1 knows how well they are protected. I got one that looked like UPS had played football with the box and the inner box was perfect, as was the camera. This fellow sold you a damaged camera, that's all there is to it. Get your money back, and do it soon. Too bad about the duty and import tax and all since I have a perfectly functioning but worn cosmetically one on the sale portion of this site. Have a look at the pics and one of them shows the LCD displaying a color picture, that's what they are supposed to look like. Good luck with your refund. Bob.
 
i noticed you can get out of hong kong a new(old stock no doubt-boxed with everything) Rd-1 for $1647 US ($1747 AU) with free delivery. even with 10% tax and $60-80 goverment fee it still workes out cheaper,,cheaper than a bunch of second hand asking prices too. or of course the RD-1s are available for around the $2050-$2100 mark

Hi Bob, the payment was made via bank transfer, Ive told the seller I wish to return the camera for a full refund. He's yet to reply back to this, although it was only earlier this morning i sent the message.

This might be an expensive lesson. I hope your seller doesn't just disappear on you. If he does, the only thing I can see to do now is a charge back, if your financial institution will offer that service. If he doesn't respond within a day or two, do the charge back if possible, as your recourse with eBay is limited. Best of luck.

Something serious happened to do that kind of damage, and I'd guess that other things got whacked around pretty hard when that occurred.

i'd say! particularly as you were no doubt convinced to pay via bank transfer instead of using pay pal to save what... $10-20 in postage fees that he offered if paid by bank transfer!

still its no good going on about that, it doesnt help and whats done is done.

i hope for your sake tekst the seller responds soon and does the right thing.

you still have avenues you can take though. check into the bank thing as said-they may be able to help . you can still report to ebay if he doesnt resolve it although you cant get money through Ppal. the Aus post insurance i think (?) he has to chase up being the sender, but was the package damaged enough to cause this? the package would have to look like it was run over by a truck. after i had a look at the box ect it would have come in i would agree its unlikely it was damaged in transit. how well was it packaged? was there anything lying between (on top of) the lcd screen

but on the good side is that you have his name and address (and bank details) and he is near you. so taking legal action against him will be easy. you could send him a letter from a lawer or collection agency that will charge him additional costs if he doesnt pay. or simply send him a registered letter asking for the refund, give him the required 14 days to respond and then go to small claim court and get a date set for a hearing. if he doesnt show up then the court will auto rule in your favour

we had a case here a while back and the courts ruled in favour of a buyer that bid on ebay and said whats discribed in it is a binding contract. your camera add clearly states it was in good working order.

Of course this camera could have been a scam, but in favor of the seller I must say that I have a nikon d50 that I always carried in a photo bag, LCD upwards, and some day I just found it in my bag with a screen looking exactly like the one on your pic.

I never understood how it could have happened, as I did not notice the merest shock between the moment it was ok and the moment it was broken. Of course, although the camera was under guarantee, nikon charged me for the repair, saying it had been damaged by a shock.

That's why I'm now curious about the DIY repair options, should anything similar happen to my R-D1.

I hope you'll be able to sort this out quickly and peacefully with the seller!
 
The camera was packaged very well, original black box with all foam inserts and in perfect shape, even had what looks to be the factory outer packaging; brown cardboard box with serial number and item details etc.

Looking back at the ebay ad, the photo he listed which shows the rear of the camera; it is clearly taken at such an angle so that you cannot see the pre-existing internal damage to the lcd...With the lcd switched off, ive now noticed that you can see internal damage (provided a decent light source). So yeh, seems to me fairly obvious that he knew the camera was not 100 percent.

make sure you save the page and pictures, print it out and file it to keep a record. keep all packaging and all emails as well
