I assume you're holding the camera horizontally and are refering to the position of the secondary (moving) image being slightly higher or lower than the primary image. This is not unusual in the many M cameras I've seen over the years, but it's a gradual progression in position change through the focusing range, not abrupt as you describe. Typically, you'll see it if for example, if the image alignment within the patch is perfect at infinity but gradually becomes slightly higher or lower at the minimum focus (0.7 m is worst). Some M's are better assembled than others where the problem is nil or nonexistent, but usually it's not bad enough to make focusing difficult. Also keep in mind that some of of it may be induced by viewing error through the eyepiece. Try adjusting your eye position slightly while looking through the finder to minimize the vertical misalignment.
