M2 - should I ask for a refund?

Alright, calm down. This is a minor dispute, not some grand conspiracy scheme or huge criminal offense.

The seller didn't steal the money, he used a generic photo to sell a camera in slightly worse condition than the buyer expected. Another buyer may have been thrilled, it's the luck of the draw. The fact is, the buyer was sent a slightly unsightly working M2, and he didn't like it. OK, it happens.

So send the camera back, get your money back, and that's the end of it. PayPal will refund you. It's not the end of the world, a horrible crime, or even some giant embodiment of evil, it's simply a minor deal gone awry.

You people act as if this seller was Bernie Madoff. Some people do hundreds of eBay deals per day. If you're not happy with a deal, work it out with the seller, get your money and move on to the next one.

You're supposed to be big boys, not perpetual victim crybabies.

Now that I can review the pictures in the listing and the actual camera, it is obviously a case of fraud. Don't bother with communication with the seller without starting a 'Dispute' with either PayPal oe Ebay, its all the same thing really for your money back.
If the seller refunds your money then all is well, if not then its up to PayPal if you used them to make it right. Probably they will not be able to recover funds from this but if you have used a Credit Card, then also contact the Card issuer and explain the situation and file a complaint of fraud.
This is blatent fraud, the camera in the stock photos in NO WAY looks like the pictures we have been presented with here. Do not listen to anything that the seller tells you to take up time and make you go away. Good luck!-Dick
 
If it was mis-adevertised, it needs to returned no matter why you bought it or what you paid for it. If it was advertised as being clean, then it should be. It's not a matter of interpretation.
 
I think you can find a better M2 for that price, but going by the pics I see why you bid...

eBay seems too "buyer beware" for me anymore...
 
Having gone through a similar issue with some guitar gear a few years back, I'd suggest just to file the claim with paypal and get your money back that way. Plus "on an overseas photographic assignment" sounds like bull to me. Maybe he's shooting in Nigeria? 🙂 And do grab screenshots of the listing and file the claim immediately. The sooner, the better.

If he simply files a PayPal dispute, and does exactly what I told him to do, he will get his money refunded as soon as he obtains signature confirmation that he returned the item.

No need for histrionics.

If he listens to the other "advice" he received, such as filing simultaneous eBay, credit card, AND PayPal disputes, he will probably lose the dispute.

Like I said, it's not a big deal and it's not the end of the world. He has no risk if he follows the correct dispute procedure.

As I also said, he could put a one pound rock in a box, keep the M2, and send the rock to the seller with signature confirmation of delivery, and he would still win the dispute, get his money back, and keep the camera too.

But nobody here is THAT dishonest, I'm sure.
 
The person who gave him "advice" told him to file an eBay dispute. This is totally incorrect.

He has to file a PAYPAL dispute called SNAD. "Significantly not as described".

That will force a refund.

You have a vivid imagination. I also advised him how to get the camera AND the money free. Yes, sure, I'm the seller.

I've spoken to the seller who seems to be OK and has agreed to a refund. He claims it was a mixup and he sounds genuine ... so I've returned the camera - and am now looking for another M2. But not on ebay.
 
You've the camera long enough to try it out. And as suggested upthread it may be a good user camera, although not in the cosmetic condition you were led to understand.

Perhaps there is room for you to keep the camera, and negotiate a lower price?

You would not need to buy again, and he would not need to sell again.


Edit: ooops, I've just seen that the camera is already on its way back to him.
 
One bad experience doesn't mean everything on eBay is no good. I've bought and sold thousands of items on eBay with virtually no problems.

I REALLY hope you sent the camera back with SIGNATURE DELIVERY CONFIRMATION, or this may be far from the end of the story.

If you didn't you just forfeited all protection from PayPal and eBay.

Probably for the best Jon, it takes an awful lot of film to brass up the sprockets like that, it had a hard life

I finally got my refund back off the seller ... after a worrying time when he de-registered from ebay and never answered my emails and calls.

Well all's well that ends well. I'm now the proud owner of another M2, which this time actually is in good clean condition (as advertised) - and the difference is amazing. This one really is smooth, clean and a pleasure to use. It came from KEH.
